Does anyone have any info on the following delema?
I rented an office from someone. We went month to month. I paid last month, and it was to be my last month. It is now the 4th of the next month and I still have a few items that I need to get. This person now says that I `forfeited` all my goods by not paying this month. Is this legal? Dont I have some time before he can claim the stuff and keep me out? Can I just take what is mine and let him call the police, or should I go with police escort? Any facts will be appreciated. This is in NY state.

What would really help you at this time is takeing a look at your rental/lease contract.
That should have all the answers.By most state laws the landlord cant hold your property.Unless there is ill will and broken agreements .(PER CONTRACT)You really need to get that agreement and read it throughly.

This is the part that you should focus on in your agreement..Make sure you didnt sign anything agreeing to the above

There was no lease. Just oral agreement of month to month. The remaining items were sold, but the buyer has not picked them up yet. Just a lame predicament. Thanks for the advice. [Wink]

When you say they were sold, was that you selling the items or the landlord selling them?

I'm not sure about how the law would apply to this scenario, but if I were in your position, I'd call the police and have them show up with me when I went back to get my things. At least then you'd have your back covered if the landlord tried to say you broke in or anything. I did the same thing when I left the ex, and needed to go back and get my stuff (and in particular my $10,000+ Neo Geo collection), I called the cops and let them sort of stand at the side to be witnesses that I wasn't breaking into the house or trying to start trouble with her. I also had a friend with me helping pack up so I could be in and out a lot quicker. You could try the same thing. I don't see what that would hurt.

Thats the plan! I sold the items before I left, and the purchaser has not picked them up yet. Thats why they are still there.
